1. Agreement to Terms

By accessing or using the SkillGrab Challenge website and services (the "Service"), provided by SkillGrab Challenge Pty Ltd ("SkillGrab", "we", "us"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

SkillGrab provides a skill-based online claw machine game where players can win real prizes. The outcome of the game is determined solely by the player's skill, precision, and timing. The Service is not a form of gambling, a lottery, or a game of chance.

3. User Accounts

  • Eligibility: You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent and warrant that you meet this age requirement.
  • Account Responsibility: You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
  • Accuracy of Information: You agree to provide true, accurate, current, and complete information about yourself as prompted by the Service's registration form.

4. Subscriptions and Payments

  • Free Plays: New users may be offered a limited number of free plays upon signing up.
  • Subscriptions: Access to the full version of the game requires an active subscription. Subscriptions are billed on a recurring basis (e.g., monthly) as specified at the time of purchase.
  • Billing: You authorize us to charge your chosen payment method for the recurring subscription fees. You are responsible for keeping your payment details up to date.
  • Cancellation: You may cancel your subscription at any time through your account dashboard. The cancellation will take effect at the end of the current billing period, and you will not be charged for subsequent periods. No refunds are provided for partial subscription periods.

5. Rules of Conduct

You agree not to use the Service to:

  • Engage in any activity that is illegal or fraudulent.
  • Use any automated software, bots, scripts, or other mechanisms to play the game or manipulate the Service.
  • Exploit any bugs, glitches, or vulnerabilities in the game mechanics.
  • Harass, threaten, or defraud other users.
  • Attempt to decompile, reverse engineer, or otherwise attempt to obtain the source code of the Service.

Violation of these rules may result in the immediate suspension or termination of your account without a refund.

6. Prizes and Fulfillment

  • Winning Prizes: All prizes are won based on the successful application of skill within the game. There is no element of chance involved in winning.
  • Prize Availability: All prizes are subject to availability. We reserve the right to substitute a prize with another of equivalent value without giving notice.
  • Fulfillment: To claim a physical prize, you must provide an accurate and complete shipping address within Australia. We are not responsible for prizes lost due to incorrect address information provided by you. Shipping and handling are managed by us.
  • No Cash Alternative: Prizes are non-transferable and non-exchangeable, and no cash alternative is offered.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of SkillGrab Challenge Pty Ltd and its licensors. The SkillGrab name, logo, and all related names and logos are trademarks of SkillGrab Challenge Pty Ltd. You are granted a limited, non-exclusive, revocable license to access and use the Service for your personal, non-commercial use.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

9. Disclaimers and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by Australian law, SkillGrab expressly disclaims all warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages resulting from the use or the inability to use the Service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice of any material changes. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
